So a small band in a big shed would be the safest fit, to start. A big band in a big shed at reduced capacity would create such outrageous scalping that it may as well be glamping at Coachella.

Due to the neutrality rule here we won't discuss the "commercial enterprise" aspect of the megachurches.
The cases with religious activity exceptions under the Free Exercise clause, as they appear in opinions, always avoid the obvious question that someone is making a value judgment on the "legitimacy" of the religion. You also see some of that in the Free Expression cases, which are supposed to be content neutral, such as the stripper (really, the club owner) getting around obscenity/zoning laws that restrict the dancer's "expressing her art." Same with the art/stage cases.
Anyway, the real Constitutional issue with the pandemic restrictions lies in the "taking of property" clauses.

So a small band in a big shed would be the safest fit, to start. A big band in a big shed at reduced capacity would create such outrageous scalping that it may as well be glamping at Coachella.
The only big bands out there are Phish & DMB, nobody else in the jam world is filling a shed or even selling one at half capacity. Panic, Bob Projects, Phil projects, SCI, UM & TTB are next in terms of seat fillers and while they may sell out their hometown markets, they play much smaller venues on the road. Then you have the Twiddle, Pigeons, JRAD, Billy Strings & Greensky level that’s just below that. And no shed in the midwest (Deer Creek, Alpine, Pine Knob, Riverbend, Blossom, etc...) is booking any of those bands. Until we can get theaters back, I think we’ll get regional tours, drive ins, multi band one day events in fields & abnormal venues. We’re just lucky that the bands we all like aren’t beholden to Ticketmaster & live nation venues. Phish is probably the biggest act affected & I bet they come back w/ Dick’s for Labor Day. Most of the bands we all like can do independent shows anyplace & and in any format.

The superbowl stadium holds 66,000; they admitted 22,000 for the game. That's my point--or hope.
And while we're looking at the numbers, the new COVID cases in the US at 122,000/day recently would be two sold out games at the superbowl stadium.
With an average of 3,300 people dying from it per day, one week's worth of deaths equals the crowd at this year's game. This is just a graphic way to picture the enormous tragedy going on--and that doesn't account for the personal losses experienced by their family members. When the numbers get big. we tend to lose sight of what is really happening.

It is with heavy hearts that we announce today that the 9th Dark Star Jubilee is being canceled for 2021. We had hopes for making it happen, but due to a variety of issues stemming from the pandemic, the Jubilee as we know it just cannot take place this year. We are all super bummed and we cannot wait to get together with our favorite fans for our favorite annual celebration in 2022. All tickets will be refunded automatically to be received within 7-10 business days. Please take a second to digest.
Now on the upside and with your safety as the top priority, TK Pro Presents is offering an alternative for 2021, the Dark Star Jubilation, that we are confident will happen and where we are confident that you will be safe. Dark Star Jubilation, is a socially distanced event with 2-5 person pods featuring 2 sets of DSO each night on May 28 and 29, 2021 at Legend Valley.

Making a shift to provide the fans with something that they can count on in 2021, TK Pro Presents introduces the Dark Star Jubilation: a weekend of Socially-Distanced Concert Pod shows at Legend Valley May 28 & 29, with each show featuring two full-set Dark Star Orchestra performances.
Each concert pod has room for two to five patrons; the ticketing page offers each available pod as a selection on the checkout. During the checkout process, a very limited number of socially-distanced campsites will be available, while supplies last. For fans who choose to add camping to their online ‘pod ticketing’ order, the two night camping fee is a total of $150 per campsite (to host your pod crew of two to five patrons only).
The socially-distanced evenings modify the Jubilee to Jubilation as current times and live events have transformed and reshaped according to public health policies with safety for the fans, artists and staff as the primary focus.
