1. Police to step up roadblock/checkpoints: "Police in Virginia are gearing up for an intense enforcement period to combat drunken driving during the end of summer. 2. Virginia "open container" law changed but only slightly. Used to be, no open containers in the vehicle or the driver was charged. First and foremost, the driver CANNOT drink while driving, no matter how little. Now, if there is an open container, it is a "rebuttable presumption" that the driver is drinking. That means he could start with a ticket but offer evidence that the passengers, and not he, were drinking. The officer can take into account whether the driver appears to have been drinking, what the passengers say, etc. It's designed to let people drink in an Uber/Lyft and the driver is protected. The open container can't be in the passenger area or within driver's reach but the trunk or "way back" of a stawag are OK. So if you are carrying a half bottle of vodka for bloodies tomorrow, don't set it on the back seat. I have heard that if the cop wants to be a dick about it, a cardboard 12 pack with one beer missing is an "open container." It's not just the half-full (or even empty) can. 3. § 18.2-323.1. Drinking while operating a motor vehicle; possession of open container while operating a motor vehicle and presumption; penalty.
A. It shall be unlawful for any person to consume an alcoholic beverage while driving a motor vehicle upon a public highway of this Commonwealth.
B. A rebuttable presumption that the driver has consumed an alcoholic beverage in violation of this section shall be created if (i) an open container is located within the passenger area of the motor vehicle, (ii) the alcoholic beverage in the open container has been at least partially removed and (iii) the appearance, conduct, odor of alcohol, speech or other physical characteristic of the driver of the motor vehicle may be reasonably associated with the consumption of an alcoholic beverage.
For the purposes of this section:
"Open container" means any vessel containing an alcoholic beverage, except the originally sealed manufacturer's container.
"Passenger area" means the area designed to seat the driver of any motor vehicle, any area within the reach of the driver, including an unlocked glove compartment, and the area designed to seat passengers. This term shall not include the trunk of any passenger vehicle, the area behind the last upright seat of a passenger van, station wagon, hatchback, sport utility vehicle or any similar vehicle, the living quarters of a motor home, or the passenger area of a motor vehicle designed, maintained or used primarily for the transportation of persons for compensation, including a bus, taxi, or limousine, while engaged in the transportation of such persons.

The farm can have its rules about drunk biking but it will just be under rules about dangerous behavior, drunk or not.
You are liable if you get drunk (or not) and hurt someone, bike or no bike.
I suppose the cops could write someone for "drunk in public" or "disorderly conduct" on the farm because it is "quasi-public property" much like a shopping center. Anyway, it won't matter what you think the law is or ought to be in that situation; you will lose the argument. "Never debatable, always appealable" an old judge around here used to say.
But for first timers, the cops on site are cool and leave people alone; they aren't looking for trouble. Be nice to them.
While we are on the subject, the fire marshals go around the campgrounds looking for dangerous stuff or code violations, especially large propane tanks (discussed elsewhere) and last year I saw them giving a decrepit home-made RV rig the hairy eyeball.

Also remember that any speed in excess of 80mph (regardless of posted speed limit) in VA is 'reckless driving' and they can take your license and run you through the system. I came within a hair of getting hit for that a few weeks ago on the way to FloydFest. Don't give them an excuse to pull you over. If they do, don't do your Dennis Hopper shtick. Be nice. They'll know you're on your way to Lock'n, so don't make up a story about taking your disabled grandma backpacking in the Blue Ridge.
When you get to the festival grounds, assume there's a K-9 unit available. Two years ago, I made the mistake of driving out of the festival on Sunday to get to another area where my friends were packing up. When I went back in the gate, I became a training session for their K-9 unit and new recruits. I was offered a one-time amnesty if I declared and produced any illegal materials from my vehicle. I looked over at the dog, who looked back at me with a slight shaking of his head. A dog can sniff out a long line of cars real quick and you'll get pulled aside quicker than you can say OG KUSH. The offer of Amnesty can be revoked at any time if you get obstinate and/or have considerable quantities.

And I got one of those tickets earlier this summer in Buckingham on my way to Nelson, on that glorious stretch of Rt 60 that just calls out to run it like a scalded dog.
