They claim they are digitizing records for preservation; record companies call BS. Anyway, Brewster Kahle, the head of internet archives (which has the Wayback Machine) is notorious for fighting copyrights and similar restrictions on access to published works. An interesting back-and-forth here. Reminds me of Napster's beginnings.
