As for Floyd Fest… talk about dropping the ball. They obviously didn’t do their due diligence on the site.
1.) To allow work to begin without permits is a huge mistake, also it means that local officials weren’t paid off and this is their “push back”. Had they “greased the right palms” the permits would have already been on hand and whatever environmental opposition came to be would have been handled by the festivals political allies.
2.) To not do the due diligence on all environmental factors and local building codes is just negligence. They’ll probably face fines locally and get tied up in legal battles with environmental groups for years at the local level, the state level, the appellate level and maybe the Supreme Court. If they think they’ll have this wrapped up by next summer their high… if there’s one Bog Turtle on that property it’s over… if they’ve killed or displaced any by their actions already then they’re probably gonna have to pay even more money.
As for using Lockn’s site… that’s a tough call for Pete to make. Why would you help a competitor??? In a perfect world we’re everyone helps everyone, I’d say sure it would work but in reality, it’s not good business unless Floyd Fest wants to buy “Lockn Farm” and move their site & operation to there.

On the other hand, not getting the construction permits and related approvals is simply amateurish and worse, especially when you know there are people out to get you.
Next trick, the opposition forces will sprinkle a few arrowheads around.

Because I’m pretty sure the people that run Lockn & own the site still believe that there will be events held there under their banner in some shape or form at some point in the future, otherwise they’d sell the property, because as it sits idle it’s a poor investment. Regardless of what their current status is, Lockn is still an entity and would be considered, IMO, a competitor of FloydFest based on location and crossover artist genre bookings.

In 2016 the VA General Assembly tasked the VA DEQ (Department of Environmental Quality) to re-write and consolidate its rules and regulations dealing with Erosion & Sediment AND Stormwater Management. DEQ formed an advisory committee to study the issue. This committee held its final meeting on September 13, 2022, although the public comment period does not end until April 10, 2023. It issued a Notice of Intended Regulatory Action and published a list of regulations that would be eliminated or modified. It was about this time that Floydfest applied for its DEQ permit (DEQ states it has been working with the organizers for the last six months). The new festival site was subject to inspections on January 23 and March 01 of 2023. The organizers received a letter on March 06 informing them that their plan (filed six months before) has not been approved. Although there is no final order against which this application can be evaluated. This is the issue that has delayed the move to the new site - a seven year long regulatory re-write where it appears no-one wants to approve a project based on rules known to be changing.
But wait, there's more - at the local level Floyd County has changed its local municipal code to now require Board of Supervisors approval by event. This change took affect in October and was in response to public comments such as, "we don't want to live by a playground for the rich", and comments related to "additional risk to locals" (risk undefined).
Finally - it will become an argument about turtles and butterflies. The Center For Biological Diversity is making a number of arguments (some exaggerated and some just plain untrue) that will have to be dealt with at some point. When I first read the linked articles I thought this was the main issue but it has yet to be addressed.
Sorry for the long bitch session but what a mess. It's a miracle any of these things happen.

And here are two dynamics which often happen, which I have seen, but can't say happened here: the officials give the applicant assurance, from experience, that everything will go through, so the applicant gets to work, and then the approval doesn't appear. Or, the accommodating and experienced administrator leaves, perhaps retires, and the replacement is a hard-ass who hates everyone and is on a power trip, putting his agency's tiny universe ahead of the greater good, and sets it all back.
In a matter on which I recently worked, the agency responded with a letter (letters are in writing, lest we forget) that the applicant's plan was fine and then, when the project was completed, said it never was approved in writing, and forced the organization--a non-profit--to tear out much of its work, work that was both beneficial and harmless.

They intentionally kept the size small, so revenue was capped for the new site, but could possibly expand at a larger site (contrary to their philosophy).
I'll be interested to learn the cost of cancelation.

FloydFest, a five-day celebration showcasing more than 100 performers, has had an annual regional economic impact of about $4 million since its 2002 founding, according to festival organizers.
Even so, county officials and local business owners seem to be taking a “c’est la vie” attitude to the cancelation in April of this year’s FloydFest, which was scheduled for July.
Organizers had hoped to move the festival this year from Patrick County to more than 200 acres off U.S. 221 in Floyd County but couldn’t get the site ready in time due to permitting issues.
“It’s just really sad … for all of the people who have been working hard on it,” says Lydeana Martin, Floyd County’s community and economic development director. “But ultimately, it was a mighty aggressive timeline anyway, so I really think it’ll be a better experience for everyone for having this extra year.”
With a lineup ranging from jam bands to bluegrass, FloydFest has drawn about 15,000 fans annually — save for 2020 when it was canceled due to the pandemic, according to Sam Calhoun, chief operating officer of FloydFest organizer Across-the-Way Productions Inc.
Hill Holler, another entity associated with FloydFest, paid $2.25 million for the Floyd County land, with plans for it to become FloydFest’s permanent location. Organizers made the move because festivalgoers routinely requested on-site parking and camping instead of taking shuttles, according to Calhoun. Organizers also wanted to hold the festival in its namesake county.
After the cancelation, about 70% of ticket holders rolled over their tickets to the 2024 festival instead of requesting a refund, Calhoun says.
Taking a glass-half-full view, James Houchins, Patrick County’s director of tourism and marketing, says organizers of Front Porch Fest, a four-day music festival held in Stuart over Labor Day weekend, have seen a recent uptick in interest. Front Porch Fest, he says, is a “smaller version” of FloydFest, and he suspects the increase in ticket sales is due to fans seeking a FloydFest substitute.
Houchins declined to estimate what Patrick County might lose in tax revenue from FloydFest’s cancelation. Martin didn’t have an approximation either.
“In a little community like this,” Martin says, “every dollar does matter.
